1. The "Work-for-Hire" Guarantee
Unlike traditional SaaS platforms that license software to you, BackAI operates as a Service Provider.
Intellectual Property Rights
Upon full payment for the applicable billing period, you (the Client) retain 100% ownership of all code, database schemas, Docker containers, and infrastructure configurations generated by BackAI. You grant us a limited, non-exclusive license solely to develop and maintain the software for you during the term of the subscription.
2. Service Level Agreements (SLAs)
We adhere to strict turnaround times to ensure velocity. While we strive to meet these targets 100% of the time, they represent operational goals rather than financial guarantees, except where specified in an Enterprise Master Services Agreement (MSA).
- Pilot Plan: Standard Code Review within 48 business hours.
- Scale Plan: Priority Code Review within 24 business hours.
- Enterprise Plan: Guaranteed 4-hour review turnaround (Business Hours).
3. Payments & Cancellations
Subscription Basis: Services are billed on a recurring monthly basis. You may cancel at any time.
Pausing: You may "pause" your subscription. During a pause, your code remains live and your infrastructure remains operational (subject to cloud provider costs), but no active development work will occur.
Refunds: We offer a 14-Day Money Back Guarantee for the first month of service if you are unsatisfied with the quality of the initial code deliverables.
4. Liability & "Zero Hallucination" Policy
While we use "Agentic AI" workflows designed to eliminate hallucinations via Test-Driven Development (TDD) and Human Review, software engineering inherently involves risk.
BackAI provides the software "as is." While we guarantee our infrastructure management uptime (99.9%), we are not liable for business losses incurred due to logic errors, third-party API failures, or misuse of the codebase after it has been handed off.
5. Non-Disclosure (NDA)
We respect your agency's client confidentiality. We are happy to sign a mutual Non-Disclosure Agreement (NDA) before any technical briefing. All data shared with our engineering pods is treated as strictly confidential and is isolated from other clients.
